Terms of Service
The agreement between you and FloorGen for using FloorGen: your account, your plans, AI agents you connect, acceptable use, and the limits of what the service promises.
Last updated
These Terms of Service ("Terms") are an agreement between you and FloorGen, a company organized in Delaware, United States ("FloorGen", "we", "us"). They cover your use of the FloorGen website and app at https://floorgen.app, its API, and its MCP server for AI apps (together, the "Service").
1. Accepting these Terms
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a company or other organization, you confirm that you can bind it to these Terms, and "you" includes that organization. If you do not agree, do not use the Service.
2. Who can use the Service
You must be at least 16 years old to create an account. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms. You may not use the Service if the law prohibits you from doing so.
3. The Service and pricing
FloorGen is a browser-based tool for drawing 2D floor plans and viewing them in 3D. With an account, your projects sync to our servers so you can open them on other devices, and you can connect AI apps that read and edit your projects through our MCP server. Without an account, your projects are kept in your browser, and we keep a copy of each one on our servers, without traced images, as the Privacy Policy describes. That copy is not a backup or sync: you cannot open it yourself.
The Service is currently free. We may introduce paid plans or features in the future. If we do, we will tell you before anything you use starts to cost money, and you will not be charged unless you choose a paid plan.
We are constantly improving the Service, so features may be added, changed or removed. We will try to give notice before removing something you rely on.
4. Your account
- Give us an email address you control and keep your account details accurate.
- Keep your password, API keys and connected apps secure. You are responsible for activity under your account, including activity by anyone or any app you give access to.
- Tell us through the contact page right away if you think someone has accessed your account without permission.
- One person per account. Do not share your sign-in details or create accounts by automated means.
5. Your plans and content
You own the floor plans, projects, notes, images and other material you create or upload ("Your Content"). We do not claim ownership of it.
You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, transmit and display Your Content only as needed to run the Service for you: for example, to save and sync your projects, render them, keep their history, and pass them to AI apps you connect. For projects made without an account, it also covers keeping the copy described above, and letting our staff view it, to understand how the Service is used and to improve it; we do not publish them. This licence ends when Your Content is deleted from the Service, apart from copies kept for the limited periods described in the Privacy Policy.
You are responsible for Your Content and confirm that you have the rights to upload it, including any plans, drawings or images belonging to someone else. We do not use Your Content to train AI models, and we do not sell it.
Keep your own copies of anything important. The app lets you export projects as files and back them up, and we recommend doing so.
6. AI apps and agents you connect
You can let AI apps such as Claude, ChatGPT or Cursor work on your projects, using an API key you create or by approving the app through OAuth sign-in. When you do:
- The AI app acts on your instructions and on your behalf. Changes it makes to your projects, including deleting them, are treated as your actions, and you are responsible for them.
- You choose how much access to give (read only, edit, or full access including delete) and can revoke a key or connected app at any time in the app.
- The AI app is provided by a third party, not by us. Its provider's own terms and privacy policy govern what it does with the project data it reads. We are not responsible for the output, accuracy or behavior of AI apps.
- Review what an agent has done before relying on it. The app shows agent changes in its activity history so you can check and undo them.
7. Acceptable use
You agree not to:
- break the law, or infringe anyone's intellectual property, privacy or other rights;
- upload malware or content that is unlawful, abusive or harassing;
- try to access accounts, projects or systems that are not yours, or probe, scan or test the Service's security except as allowed in our Security policy;
- get around rate limits, access controls or other technical restrictions, or place an unreasonable load on the Service;
- scrape the Service, or copy, resell or rebuild it as a competing product;
- use the Service to send spam or to store data unrelated to floor planning at scale.
We may remove content or limit access where we reasonably believe these rules have been broken.
8. Not professional advice
FloorGen is a planning and visualization tool. It is not a substitute for a licensed architect, structural engineer or other qualified professional, and nothing it produces is a construction document.
- Measurements, areas, quantities and 3D views are only as accurate as the input, and may contain rounding or software errors.
- Building-code checks (for example, against International Residential Code rules) are aids to help you spot likely issues. They are not complete, may be out of date, and are not approvals or certifications of compliance.
- Requirements vary by location and change over time. Before building, buying or renovating, verify every plan with your local building authority and qualified professionals.
9. Our software and brand
The Service, including its software, design, built-in furniture and model library, and the FloorGen name and logo, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable right to use the Service under these Terms. You may use what you draw with the built-in library in your own plans and exports. If you send us feedback or ideas, we may use them without obligation to you.
10. Availability and no warranty
We work to keep the Service available and your data safe, but we cannot promise it will always be available, uninterrupted, error-free or that data will never be lost.
To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
11. Limitation of liability
To the fullest extent the law allows, FloorGen and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill, or construction or renovation costs, arising from or related to the Service, even if we were told such damages were possible.
Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) 100 US dollars. Some places do not allow these limits, so they apply to you only as far as the law permits.
12. Indemnity
You agree to defend and indemnify FloorGen against claims, losses and reasonable costs (including legal fees) arising from Your Content, your breach of these Terms, your misuse of the Service, or actions taken by AI apps or other people you allowed to access your account.
13. Ending your use
You can stop using the Service at any time. To have your account and its data deleted, ask us through the contact page. Export any projects you want to keep first.
We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or to protect the Service or other users. Where reasonable, we will tell you first and give you a chance to export your projects. If we decide to shut down the Service entirely, we will give at least 30 days' notice.
Sections 5 (licence limits), 6, 8, 10, 11, 12, 15 and any other terms that by their nature should continue will survive after your use ends.
14. Changes to these Terms
We may update these Terms from time to time. The date at the top shows when they last changed. If a change is significant, we will give notice in the app or by other reasonable means before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms; if you do not agree, stop using the Service and ask us to delete your account.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you and we consent to their jurisdiction. Nothing here takes away rights you have under the mandatory consumer-protection laws of the place you live.
16. General
These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. If we do not enforce a provision, that is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
17. Contact
For questions about these Terms or to send a legal notice, use the contact page. We do not offer support or notices by email at this time.
